E-Shop Terms and Conditions
1. Scope and Validity
1.1. These terms apply to all purchases made in the Gelardo OÜ online store at http://
www.digilema.com (hereinafter “digilema e-shop”).
1.2. In addition to these terms, purchases are also governed by the laws of the Republic of
Estonia.
1.3. Gelardo OÜ may update the terms and pricing as needed to make the online store more
convenient and secure. All changes will be published on the website and take effect upon
publication. If you placed an order before the changes take effect, the terms in effect at the time
of your order will apply, unless the law or terms specify otherwise.
2. Prices
2.1. All prices apply at the time of payment as per Section 4.
2.2. Prices include VAT.
3. Shopping Cart and Order Placement
3.1. You can adjust the quantity of products in your cart. When ready to proceed, click “Proceed
to Checkout”.
3.2. Enter your billing information, select a suitable payment method, and click “Place Order”. You
will be directed to the payment page.
3.3. Please ensure that the information provided is correct – incorrect data may cause delays in
delivery and invoicing.
3.4. The sales contract is considered concluded once your payment has been received in Gelardo
OÜ’s account.
4. Payment for Products
4.1. Payment can be made using any payment methods available at the time of order.
5. Delivery and Handover of Products
5.1. After payment is received, we will deliver products based on the contact information you
provided.
5.2. Delivery time for items in stock is generally 1–7 days. If the product needs to be ordered from
a supplier or unforeseen delays occur, we will inform you within 2 business days from the receipt
of payment and specify the new delivery time.
5.3. Once products have been handed over to the courier, we will notify you by phone or email.
5.4. Products are delivered to the parcel machine selected by you. The destination cannot be
changed afterward.
5.5. Please ensure your contact details are correct – incorrect information may cause delays, for
which Gelardo OÜ or the courier company is not responsible.
5.6. If the package is damaged during transport, please notify us immediately via
info@digilema.com or by phone at +372 5743 1807.
6. Order Cancellation and Product Returns
6.1. You have the right to cancel your order before the products are dispatched by sending a
relevant notice to info@digilema.com or by calling +372 5743 1807. Please include your order
number and account information.
6.2. After receiving the goods, you have the right to return or exchange the product within 14
days. Notify us by email or phone.
6.3. Refunds will be made within 14 days of the product reaching our warehouse. Return-related
costs (e.g., shipping) are borne by the customer, except in the case of a defective product.
6.4. Products must be returned complete and in their original packaging. For promotional
products, the entire set must be returned.
6.5. If the returned product or its packaging has deteriorated due to the customer’s fault (e.g.,
incorrect use), Gelardo OÜ has the right to reduce the refund accordingly. If the customer
disagrees, an independent expert may be involved – costs are shared equally, unless one party’s
position is found unjustified.
7. Warranty and Claims
7.1. All products are covered by a 2-year claim period from the date of receipt.
7.2. The warranty does not cover:
* Products damaged due to the customer’s fault;
* Malfunctions resulting from improper or incorrect use;
* Normal wear and tear.
7.3. If a product has a manufacturer defect, you are entitled to free repair, replacement, or a
refund.
7.4. Refunds, including shipping costs, are made within 14 days after receiving the defective
product.
7.5. In addition to the warranty, all rights provided by law apply.
8. Liability and Force Majeure
8.1. Gelardo OÜ is liable for damages to the extent specified by law.
8.2. Gelardo OÜ is not responsible for delays or damages caused by force majeure (e.g., natural
disasters, strikes).
9. Data Processing and Privacy
9.1. All customer data is treated confidentially. Secure encrypted connections ensure that your
personal and payment information is not accessible to third parties. Gelardo OÜ does not have
access to your bank account details.
9.2. Unless specified otherwise in the terms, Estonian law applies.
9.3. Disputes are resolved through negotiations. If no agreement is reached, you may contact the
Consumer Disputes Committee.
10. Additional Information
10.1. Product images are illustrative.
10.2. Product prices and availability may change without notice. If prices or information are
incorrect, Gelardo OÜ reserves the right to cancel the sale and refund the payment within 10
business days.
10.3. If a product is mistakenly listed at an unrealistic price (e.g., a €2,350 refrigerator listed for
€235), it is clearly an error and the product cannot be sold at that price.
10.4. Product information is updated regularly, but it may be outdated or inaccurate. For
